Permitted, with no brightness limit or curfew — but it must not light up the neighbours or the road. There is no permission clause: lighting is lawful because nothing prohibits it. What the by-law does prohibit is a sign that illuminates any adjacent property or the path of vehicular traffic (s.4.1(h)), and any video screen or flashing, kinetic or illusionary motion, except an electronic message display (s.5.1.1(a)).

Worth knowing before you design it

Hamilton sets no brightness figure at all for a business sign: no nits, no lux and no dimming requirement. The only control is the rule against lighting up an adjacent property or the path of traffic.

These are the Building Division’s sign permit fees: $458 for a wall, projecting, awning or canopy sign, and $261, $458 or $917 for a ground sign depending on its area. The City’s user fee schedule also lists a separate Licensing sign permit fee per property. We have not confirmed whether both are charged on the same job, so ask when you apply.

No verified processing target is recorded here for Hamilton. Ask the sign-permit office which review stream applies, when its clock starts, and whether other approvals are prerequisites.

Professional design and construction review — Professional design/review not resolved

The 2024 Ontario Building Code Compendium, Division C, Articles 1.2.1.2.(6)–(7) and 1.2.2.1.(8)–(9), distinguishes design from construction review and permits an architect, professional engineer or both for these sign provisions. Confirm the applicable Code edition, sign classification, each face area, total weight, height and mounting with the municipal building-permit office. Being below a listed threshold does not clear other structural or local requirements. Local source note (confirm applicability): Hamilton sets no size, height or weight threshold for engineered drawings. The application must give the Chief Building Official enough information to confirm the sign meets the structural provisions of the Ontario Building Code (s.3.2.3(d)), so ask whether a seal is needed.
